Steven Knecht won the dismissal of felony drug dealing charges for his client with a successful motion to suppress the evidence obtained from an illegal search and seizure.
Police officers searched the client’s closed backpack located in an apartment the client was visiting. The tenant for the apartment consented to the police searching the apartment for drugs. Previously, a confidential informant had told the police that the client was dealing drugs at the apartment and they could find the drugs in the client’s backpack.
Knecht successfully argued that a third party cannot consent to a search of an item over which another party has exclusive control. Even though the backpack was located in a common area of the apartment, it was unreasonable for the police to rely on the tenant’s consent to search the apartment to extend their seizure and search to the backpack that the police knew belonged to the client prior to the seizure.
