Indiana Marijuana Law Change
Will the penalties for possession of marijuana change under Indiana’s new criminal code? In a word, yes. The Indiana legislature has reduced the penalties for marijuana possession.
Currently, possession of marijuana is a Class A misdemeanor and is enhanced to a Class D felony if the amount possessed is at least 30 grams or if the individual has a prior conviction for marijuana possession.
Starting July 1, 2014, however, possession of marijuana will be reduced to a Class B misdemeanor, increasing to a Class A misdemeanor if the person has a prior conviction for a drug offense and a Level 6 felony if the person has a prior conviction for a drug offense and the person possesses at least 30 grams of marijuana.
