When can a child’s grandparent seek visitation with the child?

In Indiana, only three circumstances allow for grandparent visitation:

1. The child’s parent is deceased;
2. The child’s parents were divorced in Indiana; or
3. The child was born out of wedlock but the paternal grandparent can only obtain visitation if the child’s father has established paternity.

If the parents are still married, the grandparents are not entitled to seek visitation.
